Please confirm that you have read and understand Black Clauchrie Terms and Conditions herein.
Please print our terms and conditions, complete and sign our terms and conditions and send with you booking form and deposit when making a booking.
The Client - The Client is the person making the booking and principal contact or party leader and is named on our booking form and confirmation. The Client shall remain responsible for the terms and conditions. It is the clients responsibility to ensure that all party members understand fully the terms and condition herein.
The contactual relationship is between the Client and the Owners of Black Clauchire. All bookings made are subject to the terms and conditions herein.
Reservations and Booking - Online
The Client must be 21 years or over at the time of booking and deemed responsible to make a reservation and booking. Reservations and bookings may be made online. The Client must read, complete and submit the Booking Forms and Terms and Conditions declaration. The Client who signs the Booking Form and Terms and Conditions signs on behalf of all members of the party and binds them jointly and severally to these booking conditions.
Reservations - If we do not receive deposit payment within 7 working days, your provisional booking will automatically be cancelled and your chosen dates will become available unless an extension of time is agreed between the Client and Owners.
Reservations and Booking - by telephone
The Client must be 21 years or over at the time of booking and deemed responsible to make a reservation and booking. Following your telephone reservation you will receive our Terms and Conditions and a Booking Form. The Client must read, complete and sign the forms and return to our office within seven days of making your payment to confirm your booking. The Client who signs the Booking Form and Terms and Conditions signs on behalf of all members of the party and binds them jointly and severally to these booking conditions.
Please note: If we don't receive payment within seven days, your provisional booking will automatically be cancelled and you chosen dates will become available.
Payment Method
Payment can be made by debit card or visa card. For your security please telephone us or we will contact you by telephone to take your payment.
Payment by cheque must be made payable to Black Clauchrie and posted to the address:- Black Clauchire House, Barrhill, South Ayrshire KA26 0RD
Confirming a booking
You will be asked to pay a deposit of 30% of the total amount of the holiday. Holidays booked less than 12 weeks prior to arrival require the full amount of your holiday to be paid. Payment can be made by visa or debit card or sent by cheque.
Please note there is a 1.9% charge for all credit card transactions, there is no charge for debit card payments. Once payment has been made, this confirms your acceptance of our Terms and Conditions available on this website. Upon receipt of your payment we will secure your chosen property and dates, You will be sent a receipt to confirm funds received and your chosen dates.
Please note: A signed copy of our Terms and Conditions and a completed Booking Form must be returned to us to confirm the booking. Entry to our properties will be denied if we are not in receipt of your signed Booking Form and Terms and Conditions.
Payment of Balance
Cleared funds of your holiday are required 12 weeks prior to your arrival date.
Reminders for balance payment for your holiday are not sent unless requested in writing by the Client. It is the Client's responsibility to ensure that payment is received by the owners within the set time scales. The owners require the balance payment to be made by the lead Client, using one payment method only.
Please note there is a 1.9% charge for all credit card transactions, there is no charge for debit card payments.
If the balance funds are not available to the owners when due, the booking will be treated as a cancellation and the Client will notified as such.
The price of your holiday
The prices quoted at point of enquiry are valid for seven days. The owners reserve the right to amend prices quoted verbally or on the website due to errors or omissions. Clients will be notified of errors as soon as possible.
Cancellations
The Client must send written and signed confirmation of cancellation of holiday. The cancellation takes effect for the day that the cancellation is received by the Owners. If the Client cancels a confirmed booking the Client remains liable for the the full balance of charges for the full duration booked by the Client. In the event that we are successful in re-booking the Clients dates we will make a full refund less £40 administration and any other loss and expenses incurred in re-selling the holiday. We strongly recommend that you take out Holiday Cancellation Insurance.
Privacy policy
Clients: Please be advised that we do not share your and additional party details with any third party. Client and additional party names, addresses and contact details will not be sold to any third party. Newsletter We may from time to time contact you with special interest and availability offers. Photographs, filming and written articles of all Black Clauchire properties and within the grounds remain the copyright of the Owners and must not be published on the web TV or printed public media with out prior permissions of the Owners. Permission must be applied for in writing and consent must be given in writing by the owners in writing.
Deposit
Deposits are required to secure your booking if the first day of your holiday is more than 12 weeks away. A deposit equal to on third of the total cost of the accommodation is required to secure any booking. A five day working grace period will be allowed when paying by cheque. If the first day of your holiday is less than 12 weeks payment is required in full. All payments must be cleared at the bank before your date of arrival.
Good Housekeeping Deposit - 'GHD'
A deposit will be required from the client prior to occupancy. The level of 'GHD' varies from property to property and also for special events. For normal holiday lets a 'GHD' of £500 is required for the hire of Black Clauchrie House and a 'GHD' of £200 for the hire of holiday cottages. This will be put into a holding account as security against damages, loss or excessive cleaning during the period of hire. This will be refunded by a cheque within 7 working days of your departure. The Client is responsible for the property and it's contents for the duration of the booking. The Client is responsible for leaving the property in a clean and tidy condition similar to condition on arrival. Furniture should not be removed from or re-arranged within the property without prior consent.
Confirmation of Booking
A confirmed booking will be made upon the Client's fully completed booking form and receipt of payment. A confirmation letter in respect of that will be forwarded by email or post from Black Clauchrie. Any error in these details should be notified within 3 working days of receipt. Any balance of charges not received by prior to occupancy will be treated as a cancellation of the contract by the client.
Period of Hire
The hire period commences at 4pm on the first day arrival to 10am on the day of departure. Client's or guests of the client arriving early without prior arrangement will not be allowed access in to properties until 4pm. Client's wishing to arrive earlier or depart later must make arrangements in advance and directly with the owners. A small charge may be added to suit your arrival and departure times.
Damages
In the event of loss or damage to the property and/or its contents and gardens caused by the client or any member of the client's party. Full payment is required by the client for the actual cost of replacement or repair which will be taken from the 'GHD' (good housekeeping deposit) and the balance refunded.
Pets
Pets are allowed strictly by prior arrangement only. It is the Client responsibility to ensure that all members of the party, including the Client, agree to our pets terms and conditions. Client and guests of the client arriving with pets without prior arrangement may be refused entry to the accommodation. Pets are strictly forbidden from bedrooms, on all furniture and all carpeted areas within all the properties. The Client must agree to keep the dog within designated areas while inside the properties. All dog fouls must be collected, sealed in a bag and deposited by the Client in the bin provided by the Owner. Dogs must not be let loose unattended within the grounds of Black Clauchrie. Dogs must not be left unattended in all of the the properties. Any evidence of pets including odour, hair, foul and damage found within and outside the properties will jeopardise the return of the client's good housekeeping deposit. We welcome well behaved pets and responsible owners who respect that not all guests enjoy dogs.
Smoking
As a courtesy to all guests, smoking is not permitted with in the property. Any evidence of smoking found within the properties will jeopardise the return of the Client's good housekeeping deposit.
Occupancy
The number of guests occupying the properties must not exceed the numbers on your booking form. Increased numbers must be agreed in writing prior to your holiday. Should this condition not be observed, we reserve the right to refuse entry to any or all guests within the party. Any evidence of over occupancy found within the properties will jeopardise the return of the client's good housekeeping and cautionary deposit. The owners reserve the right to refuse to hand over the property to the Client or Clients party who in our opinion is not suitable to take charge. In such a case the owner will not refund the hire charges to the Client and the liability of the owner shall cease.
Weddings and Special Celebrations
The Client must inform the Owner of non-staying guests invited to any property and grounds at Black Clauchrie during the hire period for weddings, special celebrations and events. The Client must not invite non staying guests named on the booking form without prior consent. The owner has the right to ask a facility fee for non staying guests to all Black Clauchrie properties and grounds and by prior arrangement only.
Non availability of property
If for any reason beyond the owner's control (for example fire or flood damage to the property) the property is not available on the date booked, every effort will be made to find alternative accommodation. In the event that this is not possible all payment made by the client will be refunded in full but the client shall have no further claim against the owners. We shall not be liable for "acts of God" that prevent the client from travelling to the property or cancellation of travel arrangements.
Rights of entry
In the unfortunate and very unlikely event that something needs repair or attention within the property. For the undertaking of necessary repairs, maintenance or inspections we the Owners have the right of entry to the properties. Prior notice will be given to the client wherever possible and privacy will be respected at all times.It is unlikely that you are to find dissatisfaction with the property however in this unfortunate event it is the Client's responsibility to contact the Owners immediately who must be given the opportunity to rectify the problem. Under no circumstances will a refund be considered if the owners have not been given the opportunity to rectify any problems during the Clients let.
The contract effected between the hirer (client) and the owner of the property is in terms of Schedule 4 Section 8 of the housing (Scotland) Act 1988 and confers on the hirer (client) the right to occupy the property for the period agreed for holiday purposes only.
The owners of Black Clauchire have taken care to ensure the accuracy of descriptions and all information is given in good faith and correct at the time of website publication.
The owners of Black Clauchire can not be held responsible or liable for any loss, injury or accident caused to the Client or any of the Client's party. The owners of Black Clauchire reserve the right to terminate a booking at any time that these conditions are not kept in full.
